UAE Small Business Relief Extended to 2029: Who Qualifies, What Changed & How to Elect It

The 2026 relief cliff is gone — eligible small businesses can now elect zero taxable income for tax periods ending on or before 31 December 2029. But the relief is never automatic, and the revenue test looks backward at every previous period.

Key change: Ministerial Decision No. 131 of 2026 extends Small Business Relief to tax periods ending on or before 31 December 2029 (announced 7 August 2026). The AED 3 million revenue threshold is unchanged — but the relief must be elected on each period’s tax return.

What Changed: The 2026 Cliff Is Gone

Under the original framework, Small Business Relief (introduced through Ministerial Decision No. 73 of 2023) was set to expire for tax periods ending after 31 December 2026. Ministerial Decision No. 131 of 2026, announced by the Ministry of Finance on 7 August 2026, replaces that cut-off: the relief now applies to tax periods commencing on or after 1 June 2023 and ending on or before 31 December 2029.

For a qualifying Resident Person that elects the relief, the effect is powerful: the business is treated as having no Taxable Income for that period — effectively 0% corporate tax, regardless of the standard 0%/9% brackets.

The AED 3 Million Test: Revenue, Not Profit

The single most misunderstood point: the test is revenue, not profit. Your business qualifies only if its revenue (measured under applicable accounting standards) does not exceed AED 3 million in the relevant tax period and in every previous tax period:

PeriodRevenueResult
2024 tax periodAED 2.1mRelief available
2025 tax periodAED 2.8mRelief available
2026 tax periodAED 3.4mRelief lost — from this period onward
2027 tax periodAED 2.0mStill not available (2026 exceeded)

Two traps here. First, B2B revenue counts just as much as retail revenue — a micro-business with modest profit but large B2B throughput can breach the ceiling without realising it. Second, the test is cumulative and backward-looking: once any period exceeds AED 3 million, every later period has an exceeded “previous period” — you cannot regain eligibility by dropping back under the ceiling.

Who Is Excluded

  • Qualifying Free Zone Persons cannot claim the relief (a free zone company that is not a Qualifying Free Zone Person may claim it, if all other conditions are met).
  • Constituent companies of Multinational Enterprise Groups are excluded.
  • Artificial separation of a business or activity to stay under the ceiling can be denied as a corporate-tax advantage arrangement.

The Election Trap: It’s Never Automatic

Read this twice: the relief is not automatic. The election is made on the corporate tax return for each tax period. Once a return is filed without the election, the choice generally cannot be added later by amending the return — you are taxed normally for that period.

Businesses that elect the relief file a simplified corporate tax return on EmaraTax. The return confirms the election and declares total revenue — and it asks whether you are electing the relief, so make sure your tax preparer knows to say yes.

Obligations Continue Even With the Relief

Electing the relief does not remove you from the system:

  • Corporate tax registration is still required.
  • The simplified tax return must still be filed within the prescribed deadline.
  • Record-keeping obligations continue in full.

Small Business Relief Checklist: 5 Steps

  1. Pull every period’s revenue since June 2023. The test covers the relevant period and all previous periods — not just this year’s.
  2. Confirm it’s revenue under accounting standards — not profit, not cash collected, not VAT turnover.
  3. Check the exclusions. QFZP status, MNE-group membership, or artificial separation all block the relief.
  4. Elect it on the return, every period. Make sure whoever files your corporate tax return ticks the relief election — a missed election generally can’t be fixed by amendment.
  5. File the simplified return on time and keep records. The relief excuses the tax, not the compliance.

FAQs: UAE Small Business Relief

How long has Small Business Relief been extended?

To tax periods ending on or before 31 December 2029, under Ministerial Decision No. 131 of 2026 (announced 7 August 2026). The original cut-off was 31 December 2026.

What is the revenue threshold for the relief?

AED 3 million in revenue per tax period — and in every previous tax period. The threshold is unchanged by the extension.

Is the relief automatic?

No. It must be elected on the corporate tax return for each tax period. A return filed without the election generally cannot be amended later to add it.

Can I regain the relief if my revenue drops back under AED 3m?

No. Once any period exceeds the threshold, the backward-looking test fails for every subsequent period — eligibility cannot be regained.

Do free zone companies qualify?

A Qualifying Free Zone Person cannot claim the relief. A free zone company that is not a QFZP may claim it if all other conditions are met.

How does this relate to my other tax obligations?

The relief sits within corporate tax — review your position alongside your corporate tax guide and VAT registration and filing obligations. Larger businesses should also watch the e-invoicing deadlines and, for multinational groups, the Pillar Two QDMTT registration deadline of 30 November 2026.

Claim the Relief Before It’s Lost

The extension to 2029 is generous — but the election trap, the backward-looking revenue test, and the one-way door on eligibility mean small mistakes have permanent consequences. Top Next Consultant reviews your revenue history, confirms your eligibility period by period, and makes sure the election is correctly made on every corporate tax return.
